Privacy Policy

I. General provisions

  1. The administrator of personal data of users of the website located under the domain www.englishlab.online within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the General Data Protection Regulation) and the Act of 29 August 1997 on the protection of personal data (Journal of Laws of 2016, item 922, as amended - hereinafter referred to as the Personal Data Protection Act), is English Lab (which includes English Lab LLC, American English Lab Sp.zo.o., and any affiliate or subsidiary companies).

  3. The purpose of the Privacy Policy is to define actions taken in the scope of personal data collected via the website www.englishlab.online and related services and tools used by its users.

  4. In order to familiarize yourself with the privacy and personal data protection rules applicable to other websites to which the user may be redirected by clicking on the links provided on the website, please read the Privacy Policies applicable to those websites.

  5. The User who uses the website confirms that he or she has read the provisions of this Privacy Policy and the Cookies Policy and understands their content.

  6. The provisions of this Privacy Policy may be changed as necessary.

II. Collection, storage and processing of personal data

  1. Users’ personal data are processed in accordance with the General Data Protection Regulation, the Personal Data Protection Act and the Act on Providing Services by Electronic Means of 18 July 2002 (Journal of Laws of 2017, item 1219, as amended).

  2. Users are not required to provide their personal data in order to use the service. However, personal data may be collected through it, specifically and voluntarily provided by users. In such a case, the user's consent to the processing of their personal data will be obtained in accordance with the applicable provisions on the protection of personal data by the data controller, who will inform the user about the collection and processing of personal data before their collection and processing begins. 2.1. In connection with the above, the processing of users' personal data is carried out on the basis of art. 6 sec. 1 letter a of the General Data Protection Regulation, according to which the processing is lawful when the data subject has consented to the processing of their personal data for one or more specific purposes. 2.2. Consent to the processing of users' personal data consists in checking the box on the website. 2.3. The user has the right to withdraw the expressed consent at any time, without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.

  3. In the event of obtaining separate consent from the user, their personal data may be processed by the administrator also for marketing purposes, including for the purpose of sending commercial information electronically to the e-mail address indicated by the user. In the event of the user's voluntary consent, their personal data will also be processed for marketing purposes by entities cooperating with the administrator.

  4. The Website is not intended to collect and process special categories of personal data (sensitive data).

  5. The Administrator takes special care to protect the interests of data subjects, and in particular ensures that the data obtained by him/her is processed in accordance with the law; collected for specified, lawful purposes and not subject to further processing incompatible with these purposes; substantively correct and adequate in relation to the purposes for which it is processed and stored in a form enabling identification of the data subjects.

  6. Users’ personal data are stored no longer than necessary to achieve the purpose of processing.

III. Purposes of processing of collected personal data

  1. English Lab is entitled to use the collected and stored data for the following purposes: (I) providing user service, (II) concluding and implementing services provided electronically, (III) adapting the offer to the interests of users, including advertisements and commercial information, (IV) contacting users, including for purposes related to the provision of services, user service, permitted marketing activities, through available communication channels, in particular e-mail and telephone, (V) conducting research and analysis in order to improve the operation of available services.

  2. English Lab is entitled to store the collected data only to the extent necessary to achieve the above-mentioned purposes for a period no longer than necessary in connection with the use of the service and to achieve the purpose of processing.

IV. Sharing of data

  1. English Lab ensures that all collected personal data is used to fulfill obligations towards users (e.g. services for delivering subscribed messages or servicing the customer panel). This information will not be made available to third parties except when: (I). the prior express consent of the persons concerned is given to such action, or (II). if the obligation to transfer this data results or will result from applicable legal regulations.

  2. English Lab as a data controller within the meaning of the provisions of the Data Protection Act may contractually entrust the processing of collected data to other entities, subject to Article 28 of the GDPR.

  3. As part of the adopted Privacy Policy, English Lab undertakes not to rent or sell users' personal data. In the event of restructuring or sale of the conducted business or its part and transfer of all or a significant part of its assets to a new owner, users' personal data may be transferred to the buyer in order to ensure the continuation of the service.

  4. English Lab may share anonymized data (i.e. data that does not identify specific Users) with external service providers, trusted partners or research agencies in order to better recognize the attractiveness of advertisements and services to Users, improve the overall quality and effectiveness of the services provided or participate in scientific research that brings a broadly understood social benefit.

V. User Control Methods

  1. The user whose personal data is processed has the right to view their data, supplement, update, rectify, temporarily or permanently limit their processing, request their removal or transfer. Viewing, supplementing, updating, rectifying, limiting processing, deleting data or transferring them is done on the basis of the user's request sent to the e-mail address admin@englishlab.online. Such a request should include the user's first and last name.

  2. The User guarantees that the data provided or published by him on the website is correct.

VI. Right to file a complaint

We make every effort to ensure that your personal data is processed in accordance with the law. However, if you believe that we have committed a violation, you have the right to lodge a complaint with the supervisory authority (the Inspector General for Personal Data Protection or, subsequently, the President of the Office for Personal Data Protection).

VII. Security

All collected data is protected using appropriate technical and organizational measures and security procedures to protect it against accidental destruction, loss, access by unauthorized persons or unauthorized use.

VIII. Cookies

  1. The Service Provider may use cookies (cookies), i.e. files containing computer data that are saved on the end device used by the Customer so that they can be read after reconnecting to the Service.

  2. Cookies are used to adapt the content of the Service to the individual preferences of Customers, optimize the use of the Service and its individualization. Cookies also make it possible to maintain a login session on the Service. The Service Provider can use them to create statistics on the use of the Service, which allows us to continuously improve it.

  3. Cookies do not cause any changes to the configuration of the end device used by the Customer. This information is used only to create statistics on the functioning of the Service. It can also be made available to external entities, but only when required by law or in the case of entrusting the processing of information about cookies to external entities. The Service Provider uses several types of cookies: (I) Session cookies - used to identify the Customer on the Service; (II) Statistical cookies - used for statistical purposes; (III) Functional cookies - providing additional functionalities of the system.

  4. The Client may always opt out of cookies. However, if he/she decides to remain on the Service without disabling cookies, he/she consents to their downloading.
